Subject: 20179/DedicateUse/TDOT/Wilcox-DodsonAve Date: Fri, 18 Sep 1992 12:21:00 -0500 RESOLUTION NO. 20179 A RESOLUTION DEDICATING THE USE OF CERTAIN PROPERTY, MORE PARTICULARLY DESCRIBED HEREIN, AS A RIGHT-OF-WAY FOR THE RE-CONSTRUCTION OF THE INTERSECTION OF WILCOX BOULEVARD AND DODSON AVENUE BY THE STATE OF TENNESSEE. _________________________ BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That the use of certain property owned by the City of Chattanooga, more particularly described herein, be and is hereby dedicated as a right-of-way for the re-construction of the intersection of Wilcox Boulevard and Dodson Avenue by the State of Tennessee. Said property within this dedication of use is described as follows: TRACT FOUR PARCEL NO. 1: Beginning at a point of intersection between the City's existing west property line and the proposed north right-of-way line on Highway Project No. STP-H-17(9) forty-five (45) feet left of project centerline station 26 + 79.59; thence curving to the left in a southeastwardly direction an arc length of eighty-five and forty-two hundredths (85.42) feet along a radius of eight hundred thirty-six and four hundred seventy-four thousandths (836.474) feet to a point of intersection with the City's north property line forty-five (45) feet left of project centerline station 27 + 69.61; thence south 63 degrees 19 minutes 06 seconds east fifty-four (54) feet + along said north property line to a point of intersection with the existing north right-of-way line of Wilcox Boulevard; thence curving to the right in a northwestwardly direction an arc length of one hundred thirty-seven (137) feet + on a radius of eight hundred fifty-one and forty-seven hundredths (851.47) feet to a point of 0C intersection with the said west property line; and thence north 26 degrees 08 minutes 16 seconds east seventeen (17) feet + along said west property line to the point of beginning. PARCEL NO. 2: Beginning at a point of intersection between the City's east property line and the proposed north right-of-way line on Highway Project No. STP-H-17(9) forty-five (45) feet left of project centerline station 28 + 81.45; thence south 80 degrees 51 minutes 14.44 seconds east sixty-one and fifty-nine hundredths (61.59) feet along said proposed north right-of-way line to a point of intersection with the City's north property line thirty-eight and eighty-two hundredths (38.82) feet left of project centerline station 29 + 45.81; thence along said north property line as follows: southeast eight (8) feet + to a point; and thence northeast fourteen (14) feet + to a point of intersection with the said proposed north right-of-way line thirty-five and fifty-three hundredths (35.53) feet left of project centerline station 29 + 68.52; thence south 80 degrees 51 minutes 14.44 seconds east thirty and eighty-one hundredths (30.81) feet along said proposed north right-of-way line to a point of intersection with the existing north right-of-way line of Wilcox Boulevard thirty (30) feet left of project centerline station 30 + 00; thence curving to the right in a northwestwardly direction an arc length of one hundred twenty (120) feet + on a [a] radius of eight hundred fifty-one and forty-seven hundredths (851.47) feet to a point of intersection with said east property line; and thence north 26 degrees 08 minutes 16 seconds east seventeen (17) feet + along said east property line to the point of beginning. PARCELS NO. ONE (1) AND TWO (2) contain 2,542 square feet, more or less. PARCEL NO. 3: Being a slope easement on Highway Project No. STP-H-17(9) and lying north of and adjacent to the proposed north right-of-way line as described in Parcel No. 1, from the City's west property line to project centerline station 27 + 34 + and varying in width from two (2) feet to zero (0) feet +, containing 60 square feet, more or less. The above described parcel of land is for the construction of slopes outside the proposed right-of-way line. The land on which the slopes are to be constructed remains the property of the grantor. This easement shall terminate upon the grading of said easement of the approximate plane of the highway or at such time as other construction is performed by the grantor eliminating the need for the easement. PARCEL NO. 4: Being a temporary construction easement on Highway Project No. STP-H-17(9) and being an area outside of the proposed right-of-way line and slope easement line as described in Parcels No. 1 and 3 from the City's east property line to project centerline station 27 + 69.61 and varying in width from five (5) feet to zero (0) feet +, containing 151 square feet, more or less. The above described parcel of land is a temporary easement for a work area. The title to the above described land remains vested in the grantor and is to be used by the State of Tennessee, its contractors or assigns for a period of three (3) years from and after the commencement of construction. The consideration mentioned herein includes payment for the property taken, also payment for any and all incidental damages to the remainder compensable under eminent domain.
